Terms of Service

1. Agreement
By accessing, browsing, or purchasing from WAVIBOY (“we”, “us”, “our”), you agree to be bound by these Terms of Service, our Privacy Policy, our Refund Policy, and our Earnings Disclaimer. Together, these documents form the entire agreement between you and WAVIBOY. If you do not agree, do not use our services.
These terms are governed by the laws of England and Wales. Nothing in these terms removes or limits your statutory rights as a consumer.
2. Eligibility
You must be at least 18 years old to purchase or use our services. By purchasing, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.
3. Services
WAVIBOY provides two products:
- Creative Automation Studio Academy (the “Academy”): a one-time-purchase online course covering the full CAS curriculum (lessons, structured Builds, the Studio Install Kit, the business kit, and the launch playbook), with 6 months of the WAVIBOY Membership Club included.
- WAVIBOY Membership Club (the “Club”): a $79/month standalone subscription giving you access to WAVIBOY TV (weekly video drops), the Vaults (prompts, bots, workflows, resources), the Job Board with brand briefs, the community chat, online events, and Challenges.
Content and access are delivered through learn.waviboy.com, our custom-built dashboard, and associated WAVIBOY-operated platforms.
We reserve the right to update, modify, add, retire, or replace course content, Club features, tools, integrations, and platform features over time to keep the material current. We will not materially reduce the value of what you have paid for without notice.
4. Account & Access
When you purchase, you receive access to the tier you selected (Academy). Your account is:
- Personal and non-transferable. You may not share, sell, gift, lend, or give your login credentials to any other person.
- Single-user only. One account per individual. We enforce single-session login: signing in on a new device will sign you out elsewhere. Persistent shared logins or multiple simultaneous sessions will result in immediate suspension without refund.
- Your responsibility. You are responsible for all activity under your account. Keep your credentials secure and notify us immediately at support@waviboy.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these terms, without refund.
5. Payment, Billing, and Instalments
- All prices are listed in US Dollars (USD). Where applicable, VAT, sales tax, or equivalent indirect taxes will be added at checkout in line with your billing location.
- Payment is processed by Stripe. We do not directly handle or store your payment card details.
- Pre-order pricing. Pre-order prices apply only during the pre-order window (closing 5 May 2026 unless extended in writing). Pre-order buyers receive access on the public launch date, which is currently scheduled for 5 May 2026.
- Public pricing. From the public launch date forward, pricing is as displayed on learn.waviboy.com at the moment of purchase.
- Instalment plan (3-Pay). If you choose a 3-pay instalment plan, the full course price is owed on enrolment. The 3-pay schedule is a payment convenience only, not a discount, subscription, or pay-as-you-go arrangement. By enrolling on an instalment plan, you authorise us to take each scheduled payment via the card on file.
- Default on instalments. If a scheduled instalment fails or is cancelled, we will attempt collection in line with our payment processor’s standard retry schedule (typically four attempts over 14 days). Your access is suspended after a 7-day grace period from the original missed payment date. If the balance remains unpaid after the retry window, (a) the remaining balance becomes immediately due in full, (b) we may permanently terminate your access to the Academy course, all Builds, the Membership Club, the Vaults, the Job Board, and the community, and (c) we may pursue collection of the outstanding amount. Termination for non-payment is at our sole discretion and does not entitle you to any refund of monies already paid.
- Lifetime access vesting. The lifetime course access promise vests only once your final instalment is cleared. Until then, your access is conditional on continued payment. “Lifetime access” applies only to the Creative Automation Studio Academy course as purchased and to ongoing updates of that specific course; it does not extend to the Membership Club after the included or paid period ends, nor to any new product, course, masterclass, or service we may launch in the future under any other name. Future products are separate purchases. See clause 8 below for the full definition of “lifetime.”
- You are responsible for any taxes, duties, or fees applicable in your jurisdiction beyond those collected at checkout.
6. The 14-Day Cancellation Right (Digital Content Waiver)
If you are a UK or EU consumer, you have a statutory 14-day right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or equivalent EU law) to cancel a distance contract for any reason. For digital content, this right ends only when you both (a) give express consent that performance may begin during the 14-day period, and (b) acknowledge that you will lose your right to cancel once content delivery begins.
At checkout, you will see a separate, unticked tickbox to that effect. By ticking that box and completing your purchase, you are giving express consent for us to begin delivery of the digital content immediately, and you are acknowledging that you waive your statutory 14-day cancellation right. We will confirm this acknowledgement in your order confirmation email.
If you do not tick that box, your 14-day cancellation right remains intact and you may cancel for any reason within 14 days by emailing support@waviboy.com.
Whether or not you waive the 14-day right, you remain entitled to the satisfaction guarantee and any pre-order cancellation window set out in our Refund Policy.
7. Cancellation & Renewal
- The Academy course is a one-time purchase. There is no “cancellation” of a one-time purchase outside of the refund processes set out in our Refund Policy.
- If you bought Academy, the WAVIBOY Membership Club is bundled for 6 months with your enrolment and continues at $79/month thereafter unless you cancel. The standalone Membership Club is a $79/month subscription billed monthly. You can cancel either at any time in your account dashboard with one click. We send renewal reminders before each upcoming charge.
- Cancellation of Club renewal stops future billing but your Club access continues until the end of the current paid period. We do not issue partial refunds for unused time within a paid renewal period.
- Your lifetime course access (the lessons and 6 Builds, subject to clause 8 below) continues whether you renew the Club or not.
8. What “Lifetime” Course Access Means
“Lifetime course access” means access to the Creative Automation Studio Academy course for the operational life of the product, with a guaranteed minimum of five (5) years from your purchase date. During that period we will continue to host the course, provide login access, and ship updates and refinements to the existing curriculum.
“Lifetime” is not a promise that:
- WAVIBOY will operate forever as a business
- The course will remain in its current form, structure, or curriculum
- You will receive any future product, course, masterclass, programme, or service that we may launch under any other name
- You will receive ongoing access to the Membership Club after your included or paid period ends
- You will receive ongoing access to any third-party tools, integrations, or platforms referenced in the course
If we launch a new product, course, or programme in the future, it is a separate purchase. Lifetime access to the Academy does not entitle you to any other product.
If WAVIBOY ceases trading, materially discontinues the Academy, or is dissolved before the guaranteed minimum five-year period, we will use reasonable endeavours to provide enrolled members with a downloadable archive of the core course materials in their last-published form, subject to third-party licence restrictions on any embedded content.
We reserve the right to evolve, restructure, or replace specific lessons over time as the underlying tools and methods change.
9. Refunds & Money-Back Guarantee
Our full refund policy, including the pre-order window, the 14-day cooling-off period, the 3-Builds satisfaction guarantee, and what happens to instalment plans, is set out in our Refund Policy. Please read it before purchasing.
10. Intellectual Property
All course materials, including but not limited to videos, text, images, templates, prompts, frameworks, downloads, worksheets, automations, bots, community posts by Waviboy, and the AI Director Bot, are the intellectual property of Waviboy and are protected under UK and international copyright law.
You may:
- Access and use the materials for your own personal and commercial learning
- Apply the frameworks, techniques, and methods you learn to your own client work and business
- Reference concepts from the course in conversation (you own your own knowledge)
You may not:
- Copy, reproduce, redistribute, or resell any course content in any format
- Share, upload, or publish course materials (videos, PDFs, templates, prompts) on any platform
- Screen-record, download, rip, or otherwise capture course content for distribution
- Create derivative courses, workshops, or educational products based directly on our proprietary materials
- Share your login credentials or allow others to access the course through your account
- Use any automated tools, bots, or scrapers to extract course content
Violation of these terms will result in immediate termination of your account without refund, and we reserve the right to pursue legal action for damages.
11. Your Content
You retain ownership of any original work you create and share within the community (e.g. your AI-generated images, portfolio pieces, feedback posts). By posting in the community, you grant Waviboy a non-exclusive, royalty-free licence to:
- Display that content within the platform for the purpose of running the community
- Share that content on Waviboy’s social media channels (e.g. Instagram, TikTok, YouTube) with credit to you via tag or mention
If you do not want your work shared on our social channels, you can opt out at any time by emailing support@waviboy.com.
12. Community Guidelines
Members with community access agree to:
- Treat other members with respect and professionalism
- Not share, leak, redistribute, screenshot, screen-record, or otherwise reproduce any course materials, Builds, frameworks, or proprietary lesson content, whether outside the community OR inside the community to members who have not paid for the Academy. Academy course content is gated to Academy members only. Sharing Academy content with Membership Club members or non-Academy members will result in permanent termination of your account without refund, and we reserve the right to pursue legal action for damages.
- Not spam, harass, bully, or engage in discriminatory or harmful behaviour
- Not use the community for unauthorised promotion, solicitation, or recruiting
- Not post illegal, defamatory, or infringing content
- Not impersonate Waviboy staff, moderators, or other members
We reserve the right to remove, suspend, or permanently ban members who violate these guidelines, without refund. Decisions on community moderation are at our sole discretion and are final.
13. Earnings & Results Disclaimer
Waviboy is an educational platform. We do not guarantee any specific financial outcomes, client acquisition, income levels, or career results. Student testimonials and case studies represent individual experiences and are not guarantees of future performance. Your results depend entirely on your own effort, skills, market conditions, and circumstances.

14. Third-Party Platforms & Tools
Our course references and teaches the use of third-party tools and platforms (e.g. Midjourney, Runway, Kling AI, ChatGPT, ElevenLabs, Freepik, and others). These are independent services with their own terms, pricing, and policies. We are not responsible for:
- Changes to third-party tools, pricing, features, or availability
- Any issues, outages, or disputes arising from your use of third-party services
- Content generated using third-party AI tools (ownership and licensing depends on each platform’s terms)
We do not guarantee that any specific third-party tool will remain available, free, or unchanged.
15. AI-Generated Content Ownership
Work you create using AI tools during or after the course belongs to you, subject to the terms and licences of the AI platforms you used to generate it. We make no claims over your output. However, you are responsible for understanding and complying with the intellectual property and usage terms of each AI tool you use.
16. AI Characters in Our Marketing
WAVIBOY uses an AI-generated character (“Wavi”) as the visual face of the brand on Instagram and other social channels. Wavi is a creative brand asset, not a real person, and is directed by the founder. We disclose this in our public-facing communications and on the social profiles where Wavi appears.
Imagery used in our marketing material may be AI-generated. We do not use AI-generated content to fabricate testimonials, member outcomes, claimed results, or member identities. All testimonials and case studies attributed to named members are real members reporting their own experiences, with their consent.
17. Limitation of Liability
To the maximum extent permitted by law:
- Waviboy provides its services on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or harmful components.
- Our total liability to you for any claim arising from or related to these terms or our services shall not exceed the amount you paid to Waviboy in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill.
- We are not liable for any decisions you make based on course content, including business, financial, or creative decisions.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
18. Indemnification
You agree to indemnify and hold harmless Waviboy, its owner, staff, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of our services
- Your breach of these terms
- Your violation of any third-party rights
- Content you create, publish, or distribute using knowledge gained from the course
- Any client work, business activity, or commercial use of skills learned through Waviboy
19. Dispute Resolution
If a dispute arises, we encourage you to contact us first at support@waviboy.com so we can attempt to resolve it informally.
If we cannot resolve the dispute informally, both parties agree that:
- These terms are governed by the laws of England and Wales
- Any legal proceedings shall be brought exclusively in the courts of England and Wales
Nothing in this clause affects your statutory rights as a consumer under UK law.
20. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, internet outages, third-party platform failures, government actions, or acts of war or terrorism.
21. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms of Service, together with our Privacy Policy, Refund Policy, and Earnings Disclaimer, constitute the entire agreement between you and Waviboy. They supersede any prior agreements, communications, or representations.
23. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify active members by email. Continued use of our services after changes are posted constitutes your acceptance of the updated terms. If you do not agree with the changes, you should stop using our services and cancel your membership.
